1Elements and Case Citations
To establish a prima facie case of negligence under New York Law, a plaintiff must establish:
- a duty owed by the defendant to the plaintiff;
 - a breach thereof;
 - and injury resulting therefrom.
 
Further, a property owner will be held liable for damages sustained in a slip-and-fall accident only when it created the dangerous condition that caused the accident or had actual or constructive notice thereof.
